These terms cover your use of the FMIndia Android app, published by DigitalDyna. Installing or using the app means you accept them. If you do not, please uninstall the app.
WHAT THE APP IS
FMIndia is a directory and player for publicly available internet radio streams. It helps you find a station and connects your device directly to that station's own public stream.
We do not own, operate, host, control or rebroadcast any radio station. FMIndia is an independent app with no affiliation to, endorsement by, or connection with any broadcaster, network or government body — including All India Radio, Akashvani and Prasar Bharati. Station names, logos, artwork and trademarks belong to their respective owners and are shown only to identify the station you are choosing.
THE CONTENT YOU HEAR
Everything you hear comes from the broadcaster, live and unmodified. We do not select, edit, schedule or moderate it, and we are not responsible for it. That includes any advertising, opinion or programming carried in a station's own broadcast.
If you are a broadcaster and you would like your station removed from the app, email hello@digitaldyna.com and we will remove it.
AVAILABILITY
Stations go off air, change their stream address, or restrict access, and some regional stations shut down overnight. None of that is under our control, so we cannot promise that any particular station will be playable at any particular time. We check the catalogue and update it, but the app is provided on an "as is" and "as available" basis.
DATA CHARGES
Streaming audio uses mobile data, and you are responsible for whatever your network operator charges. Some stations carry a video track alongside the audio, which uses substantially more data for the same sound; the app marks these so you can see it before you play, but the choice and the cost are yours.
ACCEPTABLE USE
You agree not to:
- record, rebroadcast, redistribute or commercially exploit any stream reached through the app
- reverse engineer, decompile or tamper with the app, except where the law expressly allows it
- use the app in any way that breaks the law or a broadcaster's own terms
ADS AND THE AD-FREE UPGRADE
The free version of the app shows a single banner advertisement. An optional one-time in-app purchase removes it permanently on your Google account.
All purchases are processed by Google Play. Refunds are handled under Google Play's refund policy, not by us, though we will always help you sort out a problem — write to us first and we will try to fix it before you need a refund at all.
NO WARRANTY, AND LIMITS ON LIABILITY
The app is provided without warranties of any kind, to the fullest extent the law allows. We do not warrant that it will be uninterrupted, error-free, or that any station will remain available.
To the extent permitted by law, DigitalDyna is not liable for indirect or consequential loss arising from your use of the app, including lost data or mobile data charges. Nothing in these terms limits any liability that cannot lawfully be limited, including your statutory rights as a consumer.
CHANGES
We may update these terms as the app changes. The date at the top always shows the current version, and continuing to use the app after a change means you accept it.
GOVERNING LAW
These terms are governed by the laws of India, and the courts of Ahmedabad, Gujarat have jurisdiction over any dispute arising from them.
